4.1      For purchases from the Festival Organizer (via the See Tickets platform), cancellations and refunds can only be processed as provided here.

For purchases from ticket agency, ticketmelon, boogoomusicfest.com, the cancellation and refund policy is solely governed by Mstar(asia) Co., ltd terms and conditions specific to boogoo. The Festival Organizer bears no liability whatsoever.

For purchases from a ticketing agency, Travel Partner, the cancellation and refund policy is governed solely by the Travel Partner’s terms and conditions. The Festival Organizer bears no liability whatsoever.

  1.        Image Rights

5.1      By entering the Festival and campground areas each person gives his or her express consent to the fact that he or she may be photographed and filmed (“Recording”) and that these Recordings may be stored and distributed. This includes any film, photography, audio and/or audiovisual transmission or recording.

5.2      Therefore, when purchasing Festival Products and/or Services and/or attending the Festival and/or boogoomusicfest.com , You agree to, authorize and grant the right to use of Your image, name and voice as part of the Recordings, free of charge and without limitation, and without characterizing misuse of image or any other violation of rights, considering the fact that the Festival and DreamVille may be filmed, recorded or photographed, at the Festival Organiser’s discretion, for subsequent publication, transmission, retransmission, reproduction or distribution on TV, VOD, cinema, radio, internet, streaming, advertising or any other means of communication, DVD and home-video production by the Festival Organiser or by third parties, at the Festival Organizer’s discretion.

5.3      The Festival Organizer may also use these Recordings to promote and report about boogoo music & art festival, with the aim of ensuring the security of the Festival and/or provide them to the authorities for the purpose of investigating illegal activities and as a means of identifying, tracking and facilitating sanctioning those responsible.

  1.        Liability

6.1      Liability of the Customer and Festival Visitor

           Refusal of access

6.1.1   Those who fail to comply with these Conditions will be immediately refused entry to or removed from the Festival Site and festival campground. No refunds will be made unless otherwise agreed here.

6.1.2 The Festival Organiser reserves the right to refuse entry to multiple editions of the Festival and/or other events organized by the Festival Organiser and its affiliates, depending on the nature of non-compliance with these Conditions (e.g. in case of selling drugs at the Festival or bracelet fraud).

           Prosecution

The Festival Organiser reserves the right to prosecute any holder of forged tickets relating to the Festival and boogoo Bracelets and any person who fails to comply with these Conditions.

6.2      Liability of the Festival Organiser

            Direct damage

6.2.1   The Festival Organiser shall only be liable for damages directly and exclusively resulting from an error by the Festival Organiser. Excluded from compensation are (i) damages and losses caused by Force Majeure, (ii) consequential damages and (iii) damages caused by misconduct, recklessness or serious fault by the damaged party.

6.2.2   The Festival Organizer is not liable for damages, theft or any accidents to vehicles or persons in the Festival’s official parking lots. The use of the parking lots is always at own risk.

  1.     Rights reserved to the Festival Organiser

For security reasons, situations of unforeseeable circumstances, Force Majeure, or another demonstrable compelling reason, the Festival Organiser reserves the right to:

  • cancel or postpone the Festival, either partly or ENTIRELY;
  • interrupt or stop the Festival experiences;
  • inspect any vehicle at any time;
  • temporarily keep Festival Visitors on the Festival Site, as applicable;
  • completely or partly evacuate the Festival Site;
  • deny access to the Festival Site, regardless of possession of a valid admission ticket;
  • change the festival’s program or schedule;
  • make changes to parking lots, schedules, musical attractions and/or any other content of the Festival Products and/or Services.

Cancellation / Postponement

In the event of cancellation or postponement of the Festival, You shall be entitled to compensation in respect of the purchased Festival Products and/or Services in accordance with applicable law, but shall not be entitled to compensation for any other damages (direct or indirect).

In the event the purchase of the Festival Products and/or Services constitutes part of a larger collaboration agreement with regard to the Festival, the terms and conditions with regard to cancellation and/or postponement of the Festival under that agreement shall prevail over the cancellation and postponement provisions in these Conditions.

9.1.1   Festival Products and Services can be purchased directly from the ticketing agency, via a boogoo Account and via the See Tickets platform. A purchase can only be processed after the purchase price has been paid in full:
